Eviction Protections for Los Angeles Tenants
With the California eviction moratorium having ended on June 30, many California renters are left without the protections they had previously received from California AB-2179. However, you cannot be evicted for any rent debt which was accrued throughout the duration of the moratorium; only failure to pay rent subsequent to its ending can be a cause for eviction. Additionally, there still remains protections in place for renters in the city of Los Angeles.
Who qualifies for Los Angeles’ Eviction Protections?
Tenants residing in the city of Los Angeles who are considered low income are qualified for protections from eviction for non-payment of rent under the LA County Tenant Protections Resolution. A renter is considered low income if they have a household income that is 80% or less than the median income of their area, with adjustments being made for household size. Qualified renters are unable to face eviction for an inability to pay rent if said inability is the result of financial hardships suffered from the Covid-19 pandemic. The immunities provided by the Los Angeles County Tenant Protections Resolution are currently set to expire December 31, of 2022.
What to do if you qualify and face eviction?
Qualified Los Angeles renters who are unable to make rent payments are required to notify their landlords within no less than 7 days of their rent being due. Templates to give notice of inability to make rent payments can be found in both English and Spanish. Additionally, exercising protections granted under the Tenant Protections Resolution does not exempt the tenant from rent payments, only from being evicted as a result. The renter is still expected to repay their rent-debt at a later date. In the event that your landlord does not comply with your notice, tenants are advised to seek council from an attorney specialized in tenant protection.
